[2] By law, special rules apply to health care providers and emergency responders. Most employers with this new but growing policy do not track how long employees take off or for what reason. While the new law requires employers to separately track the delineation and use of sick leave, for employers with unlimited paid time plans, the notice, detailed payroll, or separate written statement provided with the payment of wages meets this requirement by stating that paid sick leave is “unlimited.” The new law requires an employer to pay for sick days taken by an employee no later than the payday for the next regular billing period after taking sick leave. This does not prevent an employer from adjusting compensation for the same pay period in which the leave was taken, but it does allow an employer to defer the adjustment to the next pay.
